Consent To Sue Form

I worked as an actor for American Immersion Theater Company and The Murder Mystery Company (“Defendants”) within the last three years and was classified by Defendants as an independent contractor. I was not paid for all the hours I worked, resulting in overtime and minimum wage violations. I hereby consent to sue Defendants in this Fair Labor Standards Act (FLSA) case. I understand that by signing this form, I consent to representation by the Named Plaintiff to bring any claims I may have under the FLSA (for minimum wage violations, unpaid overtime, liquidated damages, attorneys’ fees, costs, and other relief) and under the applicable state wage and hour laws of New York against the Defendant in this action.

 

I authorize HKM Employment Attorneys, LLP. and its successors and assigns to represent me in this case. By signing and returning this consent to sue, I understand that I will be represented by the law firm without prepayment of costs or attorneys’ fees. I understand that if Plaintiffs are successful, costs expended by attorneys on my behalf will be deducted pro rata from my settlement or judgment first. I understand that the law firm may petition the court for an award of fees and costs to be paid by Defendant on my behalf. I understand that the law firm may petition the court for a service award for the Named Plaintiff. I understand that the fees retained by the attorneys will be either the amount of fees received from the Defendants or 1/3 of my settlement or judgment amount, whichever is greater. I understand that if the case is not successful, I will not be obligated to pay any fees or costs.

 

I designate the Named Plaintiff in this action as my agent to make decisions on my behalf concerning the litigation, including the method and manner of conducting this litigation, entering into settlement agreements, and all other matters pertaining to this lawsuit.
